Predicting the survival benefit and immune response of immunotherapy for multiple cancers based on mutation gene sets.

This issue of the "Precision Frontier" column shared by Zhao Haitao’s research team published inGenome Medicine(IF =11.12) [1], a mutation signature was constructed and verified to predict the prognosis of patients receiving immunotherapy, and the potential immune response of different subtypes was studied by using multidimensional data.

Research background

Immunocheckpoint inhibitors (ICI) have changed the treatment of many cancers. However, the beneficiaries of ICI treatment are limited, so it is necessary to screen and predict biomarkers to classify patients. At present, many biomarkers, such as tumor mutation load (TMB), have been used as indicative biomarkers in clinic. However, some high TMB patients with gene mutation related to immunotherapy resistance are not sensitive to ICI treatment. Therefore, it is necessary to go beyond TMB and identify the specific genetic determinants of ICI treatment response.

research design

The study included genome and clinical data of 12,647 patients. There were 1572 cases in the training set (immunotherapy patients with 9 kinds of cancer) and 932 cases in the verification set (immunotherapy patients with 5 kinds of cancer). The training set was sequenced by MSK-IMPACT panel containing 468 genes.

The authors identified a set of 11 genes based on mutation, which can divide patients into high-risk and low-risk groups. The mutation of these 11 genes is related to the better response to ICI treatment, and this gene set has been proved to be an independent prognostic factor after ICI treatment.

research results

1. Identify mutant gene sets that can predict the outcome of immunotherapy.

Firstly, the survival differences of 468 genes in the training set were compared between wild type and mutant type, and 98 genes related to OS (global survival) were obtained. After that, LASSO COX regression analysis was further screened and 11 important genes were finally obtained. Through COX regression analysis, the risk score of each patient was quantified on the basis of 11 mutant gene sets. In the training concentration, the OS of patients in the high-risk group is shorter than that of patients in the low-risk group (Figure 1B). In order to study whether the gene set is limited to a specific population or suitable for different populations, the subgroup analysis regardless of age, drug use type and cancer species shows that the gene set is significantly related to the OS of patients treated with ICI (Figure 1C-E).

2. Verification of predictable immunotherapy results

In order to further confirm the value of mutation-based gene set in predicting the results of immunotherapy, it was found that the OS of low-risk group was higher than that of high-risk group (Figure 1F). The research results of predicting ICI treatment response in gene set show that the DCB(durable clinical benefit) of ICI treatment in low-risk group is significantly increased compared with that in high-risk group (Figure 1G), and low-risk patients are more likely to respond to ICI treatment (Figure 1H). These results get the same results in the verification set (Figure 1I, J).

3. Gene set is an independent prognostic predictor of immunotherapy.

Next, the author verifies whether the gene set based on mutation is an independent predictor of immunotherapy response. In the training and validation set, univariate COX regression analysis showed that the gene set was related to OS. After adjusting for drug type, tumor type and TMB, multivariate COX regression analysis showed that the gene set was still an independent predictor, which confirmed the stability of its independent prediction of ICI prognosis (Figure 2A, B). In order to determine which factor has the best predictive performance, C-index is used to compare the performance of mutation-based gene sets with TMB and drug types. The results of C-index show that the gene set based on mutation can predict the prognosis more accurately than TMB and drug type in both training set and validation set (Figure 2C, D).

4. The clinical benefit of ICI treatment can be predicted based on the mutant gene set, disease stage, CTL and 6-IFN-g gene signature.

Considering the stage of disease, CTL and 6-gene IFN-g signature have been proved to be highly predictive of the response to ICI treatment, the authors speculate that they may play a synergistic role in predicting the response to immunotherapy. The author combined the gene set based on mutation with disease stage, CTL and 6-gene IFN-g signature through Nomotograph, and provided a method for clinicians to quantitatively predict the OS of patients treated by ICI. Fig. 2E is the nomogram of Riaz cohort construction, and the calibration curve of fig. 2F shows the consistency of actual and predicted results, indicating that these signature should be integrated into the predicted nomogram of ICI treatment.

5. Potential external immune landscape of high and low risk groups

In order to further explore the relationship between immune system and mutation-based gene set, the authors conducted a multi-group analysis of TCGA cohort, and the risk score divided TCGA cohort into high and low risk groups (Figure 3A). At the genome level, the proportion of white blood cells, lymphocytes and TIL in the low-risk group was significantly higher than that in the high-risk group (Figure 3B-D). The H&E staining results of TIL ratio are consistent with the above results (Figure 3E). In addition, the proportion of immunostimulatory cells (such as CD8 T cells) in the low-risk group is also significantly higher than that in the high-risk group (Figure 3F). The above results were further tested by Danaher et al.’ s immune infiltration score (figure 3G) and immune characteristic score (figure 3H), and it was found that the abundance of immune cells in low-risk group was higher. Then unsupervised clustering was used to cluster the immune characteristic scores of patients in TCGA cohort, and the results were clustered into two immune infiltration modes (Figure 3I), and the high immune infiltration was significantly enriched in the low-risk group (Figure 3J).

In addition, the immune signature in the low-risk group was significantly higher than that in the adjacent cancer tissue; On the contrary, the immune signature in the high-risk group was significantly lower than that in the adjacent tissues (Figure 4A). The correlation of immune activity in low-risk group was significantly higher than that in high-risk group (Figure 4B, C). GSEA results showed that 13 pathways were significantly enriched in the low-risk group, including 6 immune-related pathways, such as "cytotoxicity mediated by natural killer cells" (Figure 4D). Tumors in the low-risk group are associated with significantly higher CYT scores, and the number of fibroblasts in the high-risk group is now increasing (Figure 4E, F). According to these results, the low-risk group is rich in immune cells, which can respond to ICI treatment, and fibroblasts may help the high-risk group escape. The expression of chemokines in the low-risk group is higher (Figure 4G, H), so the author speculates that the enrichment of chemokines in the low-risk group may trigger an immune response.

6. Potential inherent immune landscape of high and low risk groups

Some potential factors determining tumor immunogenicity between the two groups were compared. Mutation, new antigen load, TCR and BCR diversity in low-risk group were significantly higher than those in high-risk group, but CNV load and aneuploidy in high-risk group were higher than those in low-risk group (Figure 5A). This result is consistent with previous studies, that is, tumor aneuploidy is related to immunotherapy and decreased immune escape marker response. In addition, the heterogeneity of tumor in high-risk group is higher than that in low-risk group, which further supports the view that tumor will promote the development of heterogeneity in the presence of cytolytic activity and less active infiltration of immune cells. In order to further understand the mutation process of high and low risk groups, the mutation characteristics were described according to somatic mutation data, and four different mutation patterns were determined in TCGA cohort (Figure 5B). The frequency of these four mutation signals in the low-risk group is significantly higher than that in the high-risk group (Figure 5C). In addition, it was also found that immune checkpoint molecules (such as PD-1, PD-L1 and CTLA4) and costimulatory molecules were more highly expressed in the low-risk group (Figure 5E).

7. Copy number characteristics of high and low risk groups

Significant differences in chromosome variation were detected in high and low risk groups (fig. 6A). Local amplification peaks of immune genes with good characteristics, such as PD-L1 (9p24.1) and PD-L2 (9p24.1), were observed in the low-risk group (fig. 6B, C). GO function annotation of the specifically amplified genes showed that the low-risk group was significantly enriched in two immune-related biological processes, while the high-risk group was significantly enriched in the biological process of "positive regulation of fibroblast proliferation", but not in any immune-related biological processes (Figure 6E). At the level of mRNA expression in TCGA cohort, the expression of PD-L1 and PD-L2 mRNA in low-risk group increased significantly (Figure 6G), which was consistent with CNV data. This finding suggests that CNVs in tumor contributes to the observed difference in immune infiltration.

This study is the first time to use an independent cohort to study the comprehensive mutant gene sets of different tumor types. Through PSM algorithm, hierarchical analysis and multivariate COX regression analysis, the application performance of mutation-based gene sets in different types of tumors was tested, and the results showed that mutation-based gene sets were reliable.

This study has the following innovation and practical application value. First, different types of tumors (such as NSCLC (non-small cell lung cancer), melanoma and renal cell carcinoma) are used, which represent the most common types of cancer treated with ICI. Secondly, the application of multiple biomarker prediction model needs to understand the factors that affect the accuracy and precision of Qualcomm analysis in clinical practice. The risk score formula and threshold of mRNA expression calculation are not suitable for verification with other types of data. Therefore, this study developed a gene set based on mutation to predict the clinical efficacy of ICI treatment. The composition of the above mutations is neither affected by tissue types nor adjusted by any other biomarkers. The risk score formula and threshold of gene set based on mutation can be verified by other tumor analysis methods, such as DNA sequencing and single nucleotide polymorphism microarray analysis. Therefore, mutation-based gene sets are not affected by technological changes, even when different platforms are used in different centers. Thirdly, in practice, gene sets based on mutations avoid exposing patients to potential immune-related adverse reactions when they are unlikely to respond, and enable patients to match to potentially more effective treatments more quickly. Fourthly, the prediction performance of gene set based on mutation is compared with other factors that can predict immunotherapy, and it is found that the prediction performance of gene set based on mutation is better than all these factors.

Several limitations of this study. First of all, because some mutations may be enriched in some tumor types, the initial goal of this study is to create a panel instead of identifying a single gene (such as BRAF), because the former can contain more genes to predict the prognosis of different types of tumors. Secondly, although the immune landscape of 11 genes in the gene set based on mutation has been explored, it is still necessary to clarify the molecular mechanism of each gene affecting immunotherapy in vivo and in vitro functional experiments. Thirdly, the enrichment scores of carcinogenic pathways and the expression patterns of immune checkpoints should also be detected by immunohistochemistry.

The mutation-based gene set proposed in this study is the first comprehensive genomic marker systematically identified, which can be used to evaluate the ICI treatment effect of pan-cancer species. This study is also the largest prognostic model discovery project for cancer patients receiving ICI treatment (whether single drug treatment or combined treatment of anti-PD-1 and anti-CTLA-4). Nomoto, which combines mutation-based gene set with TMB and drug types, can help clinicians choose patients who may have a strong response to ICI treatment. In addition, it also reveals the different immune conditions of high and low risk groups, and specific genomic changes may drive the formation of these microenvironments. In a word, this work puts forward a new tumor classification method, which may guide the decision-making of ICI treatment. END

  1. General rules

  1.1 Purpose of compilation

  Guide and standardize the province’s food emergency disposal work, improve the ability of risk prevention and emergency support in the field of food security, effectively monitor and control the abnormal fluctuation of the food market in the province, ensure the stable supply of the food market, maintain the basic stability of the food market price, and maintain normal social order.

  1.2 Compilation basis

  People’s Republic of China (PRC) Emergency Response Law, Regulations on Grain Circulation Management, National Grain Emergency Plan, Measures for Implementing People’s Republic of China (PRC) Emergency Response Law in Hunan Province, Overall Emergency Plan for Emergencies in Hunan Province and other laws, regulations and relevant provisions.

  1.3 Scope of application

  This plan is applicable to the emergency situation of grain within the administrative region of this province, and the response to the procurement, storage, allocation, processing, transportation, supply, import and export of raw grain and finished grain (including edible oil, the same below).

  The emergency state of grain mentioned in this plan refers to the sudden change in the relationship between grain supply and demand caused by natural disasters, accidents, public health incidents, social security incidents and special circumstances, and the sharp fluctuations in the grain market such as out of stock, supply interruption, sharp price increase, and mass concentrated snapping up in a large area.

  1.4 working principles

  (1) People-oriented, bottom line thinking. Firmly establish the people-centered development idea, take ensuring food security and emergency supply as the primary task, strengthen the construction of food emergency security system, and ensure that it is "available, adjusted quickly and used" at critical moments.

  (2) Unified leadership and graded responsibility. Under the unified leadership of the Party Committee, according to the arrangements of the government, all localities implement the responsibility of the party and the government, and take responsibility for different levels of food emergency work according to the food affairs.

  (3) Scientific monitoring, giving priority to prevention. It is necessary to raise the awareness of preventing emergencies, strengthen the tracking and monitoring of the grain market, strengthen the prevention and resolution of risks, make timely predictions of precursors, make preparations in advance, and nip in the bud.

  (4) Timely response and efficient disposal. When there is a food emergency, we should respond immediately, report the relevant situation in time, and take corresponding measures quickly to ensure that the emergency response is quick and decisive and effective.

  2. Emergency command mechanism and responsibilities

  2.1 Emergency command mechanism

  When there is a major food emergency in the province, a command mechanism for food emergency work in Hunan Province is established with the approval of the provincial people’s government, and work is carried out under the leadership of the provincial emergency rescue headquarters. The deputy governor of the provincial people’s government is the overall person in charge, and the deputy secretary-general of the provincial people’s government, the director of the Provincial Development and Reform Commission, and the director of the Provincial Grain and Material Reserve Bureau are the responsible persons. Hunan Bureau of State Grain and Material Reserve Bureau, Provincial Public Security Department, Provincial Department of Finance, Provincial Department of Transportation, Provincial Department of Agriculture and Rural Affairs, Provincial Department of Commerce, Provincial Emergency Department, Provincial Market Supervision Bureau, Hunan Investigation Corps of National Bureau of Statistics, Information Office of Provincial People’s Government, Hunan Branch of China Agricultural Development Bank, Hunan Branch of China Grain Reserve Management Group Co., Ltd. and Changsha Railway Office of China Railway Guangzhou Bureau Group Co., Ltd. are members.

  The office of the provincial food emergency command mechanism is located in the Provincial Grain and Material Reserve Bureau, and the director of the Provincial Grain and Material Reserve Bureau is also the person in charge of the office.

  The people’s governments of cities, prefectures, counties and urban areas shall establish a food emergency work mechanism. When there is a corresponding food emergency state within their respective jurisdictions, they shall quickly set up a food emergency work command mechanism to be responsible for leading, organizing and directing the food emergency work within their respective administrative areas, establish and improve the food market monitoring and early warning system and the responsibility system for food emergency prevention and handling, timely and truthfully report information, arrange necessary funds, ensure the normal work of food emergency disposal, and, if necessary, submit it to the competent authorities to take price intervention measures according to law. When there is a food emergency in this area, we must first start the food emergency response at the same level. If the food emergency situation in this area is upgraded, it can be submitted to the people’s government at a higher level for support. After the superior food emergency response is started, it will be deployed in accordance with the superior food emergency command mechanism to complete various emergency tasks.

  2.2 Responsibilities of member units of emergency work command mechanism

  The Provincial Development and Reform Commission is responsible for the comprehensive coordination of food emergency work, the regulation of grain market and grain reserves, and the proposal for the use of provincial grain reserves (including provincial reserve oil, the same below) to the provincial people’s government; Responsible for monitoring the market price of grain, in case of emergency, with the consent of the provincial people’s government, take the lead in setting the maximum price of grain sales or take other price intervention measures to keep the market price stable according to the provisions of the Price Law of People’s Republic of China (PRC).

  The Provincial Grain and Material Reserve Bureau is responsible for monitoring the market grain situation; In conjunction with relevant provincial departments (units), improve the management and utilization mechanism of provincial grain reserves, and timely put forward suggestions on the utilization of provincial grain reserves; Responsible for the organization, processing, transportation and supply of emergency grain sources, and implement the management of the highest and lowest inventory.

  Hunan Bureau of the State Grain and Material Reserve Bureau is responsible for the implementation of the central grain reserve emergency support work within its jurisdiction, and coordinating the national reserve warehouse, special railway lines and other resources to serve the regional food emergency work.

  The provincial public security department is responsible for maintaining the public order of the food supply places and ensuring the smooth road traffic of the grain emergency convoy; Cooperate with relevant departments (units) to crack down on illegal and criminal activities that disrupt the grain market order in a timely manner.

  The Provincial Department of Finance is responsible for the financial support for the food emergency work at the provincial level.

  The Provincial Department of Transportation is responsible for the road traffic management of food emergency work.

  The Provincial Department of Agriculture and Rural Affairs is responsible for solving the emergency shortage of food production.

  The Provincial Department of Commerce is responsible for coordinating the import and export of emergency food with the Provincial Development and Reform Commission.

  The Provincial Emergency Department participates in the food emergency work in the whole province.

  The Provincial Market Supervision Bureau is responsible for the quality and safety supervision and management of food entering food production and processing units and food processed products entering food business units, and investigating and handling violations of relevant laws and regulations on food safety according to law; Responsible for cracking down on trademark infringement, illegal advertising, unfair competition and monopoly in food business activities according to law; Carry out price supervision and inspection, investigate and deal with price violations according to law, and maintain market price stability; Cooperate with relevant departments to investigate and deal with unlicensed operation in food business activities.

  China Agricultural Development Bank Hunan Branch is responsible for the implementation of loans for purchasing, storing, processing, allocating and supplying emergency food.

  Hunan Branch of China Grain Reserve Management Group Co., Ltd. is responsible for reporting and implementing the central grain reserves and other central grain utilization plans in Hunan.

  Changsha Railway Office of China Railway Guangzhou Bureau Group Co., Ltd. is responsible for the railway transportation of grain emergency work.

  3. Monitoring and early warning

  3.1 Market monitoring and early warning

  The Provincial Development and Reform Commission and the Provincial Grain and Material Reserve Bureau shall, jointly with the relevant departments (units) of the province, establish and improve the monitoring and early warning system of grain supply and demand and market price in the whole province, strengthen the monitoring and early warning analysis of grain market supply and demand and price situation, keep abreast of the dynamic changes of grain market supply and demand and price, and timely submit information on production, inventory, circulation, consumption, price and quality of major grain varieties, so as to provide a basis for formulating grain production, circulation and consumption policies.

  Relevant departments (units) of cities, prefectures, counties and cities should strengthen real-time monitoring and analysis of grain production, demand, inventory, price and grain market dynamics within their respective jurisdictions, and timely submit market monitoring as required. In particular, it is necessary to strengthen the tracking and monitoring of major natural disasters and other emergencies, report in time when there is an emergency, and do a good job in dealing with it in advance to control the development of the situation.

  3.2 Information report

  The Provincial Development and Reform Commission, the Provincial Grain and Material Reserve Bureau and the Provincial Department of Commerce shall establish and improve the emergency reporting system for abnormal fluctuations in the provincial grain market. When the grain market fluctuates abnormally, the departments of development and reform, grain and commerce of cities, counties and cities should immediately investigate and verify, report the incident to the local people’s government and the higher authorities (units) in a timely manner, and notify the relevant departments (units). In the event of a major food emergency, the municipal people’s government shall report to the provincial people’s government within 2 hours.

  4. Emergency response and disposal

  4.1 emergency classification and response

  According to the scope and degree of its influence, the emergency state of grain is divided into four levels: general emergency state (IV), major emergency state (III), major emergency state (II) and particularly major emergency state (I).

  4.1.1 General emergency state (Grade IV):Refers to the food emergency in the administrative area of a county (excluding the main urban area where the municipal people’s government is located), and the situation that the county people’s government thinks it is necessary to treat it as a general emergency.

  When there is a general state of food emergency, the county and city development and reform or the administrative department of food and reserves shall put forward suggestions and report to the people’s government at the same level for approval to start the level IV emergency response, and the county and city shall co-ordinate the implementation of the level IV emergency response and disposal measures, and the county and city people’s governments shall promptly report to the local city and state people’s governments.

  4.1.2 Major emergency state (Grade III):Refers to a state of food emergency in two or more counties and cities in a city or in the main city where the people’s government of a city is located, and the situation that the people’s government of a city thinks it is necessary to treat it with a greater emergency.

  When there is a major food emergency, the municipal development and reform or the administrative department of food and reserves shall put forward suggestions, report to the people’s government at the same level for approval to start the level III emergency response, and the municipal people’s government shall co-ordinate the implementation of the level III emergency response and disposal measures, and the municipal people’s government shall report the relevant situation to the provincial people’s government in a timely manner.

  4.1.3 Major emergency state (Grade II):It refers to the situation that there is a major food emergency in two or more cities or provincial capitals, or it is beyond the disposal capacity of the people’s governments of cities and prefectures, and the provincial people’s government believes that it is necessary to treat it with a major emergency.

  When a major food emergency occurs, the Provincial Development and Reform Commission or the Provincial Grain and Material Reserve Bureau shall report to the provincial people’s government for approval to start the level II emergency response, and co-ordinate the implementation of the level II emergency response and disposal measures. The provincial people’s government timely report the relevant situation to the State Council, and send a copy to the relevant ministries and commissions. The report mainly includes the following contents:

  (1) the variety, quantity, quality, inventory cost and sales price of the provincial grain reserves;

  (2) the use of provincial grain reserves funding arrangements, sources of subsidies;

  (3) arrangements for the use of provincial grain reserves and transportation guarantee, such as physical allocation, processing and supply, market sales, low-price supply or free distribution, and specific measures to ensure transportation;

  (4) Other supporting measures.

  4.1.4 Extraordinary major emergency state (Grade I): generally speaking, it refers to the situation that two or more provinces, autonomous regions and municipalities directly under the Central Government have food emergency state, which is specifically determined according to the standards stipulated in the National Food Emergency Plan.

  When a particularly serious food emergency occurs, all food emergency work will be carried out under the unified command and deployment of the national food emergency work command mechanism.

  4.2 Disposal measures

  4.2.1 In case of general food emergencies (level IV emergency response), the county and urban food emergency work command mechanism shall co-ordinate the implementation of level IV emergency response, and one or more of the following measures may be taken according to specific circumstances:

First, clear responsibilities and establish an effective internal control mechanism for government procurement.

1, the implementation should be exhausted.The purchaser’s use of fiscal funds (that is, funds included in budget management) to purchase goods, projects and services within the centralized procurement catalogue or above the procurement limit standard should be included in government procurement. Borrowing funds with fiscal funds as the source of repayment are regarded as fiscal funds; If the procurement project uses both financial funds and non-financial funds, the part purchased with financial funds is applicable to government procurement; Where fiscal funds and non-fiscal funds cannot be purchased separately, government procurement shall be uniformly applied.

Should the project of government procurement be implemented without government procurement according to law, the Provincial Department of Finance shall not go through the government procurement procedures, and shall not pay the procurement funds, and shall be investigated for the legal responsibility of the relevant units and responsible persons according to law. Procurement projects involving national security and secrets shall be identified by the Provincial State Secrecy Bureau, and the purchaser shall report to the Provincial Department of Finance for the record.

2. 5. Strengthen file management.The purchaser and the procurement agency shall properly keep the procurement documents of each procurement activity. After the procurement activities are completed, the procurement agency shall hand over the procurement documents to the purchaser for archiving. Procurement documents can be saved in the form of electronic files.

Two, standardize the operation, establish a transparent and efficient government procurement mechanism.

6. Strengthen budget management.The purchaser shall, in accordance with the requirements of "all the staff should be compiled", compile the government procurement budget of the procurement project in the current year in the departmental budget, confirm the source of funds for the procurement project, clarify the procurement demand, and refine the procurement items to the last level of the Catalogue of Government Procurement Items. For the procurement projects included in the government procurement budget at the beginning of the year, the purchaser shall strictly follow the approved government procurement budget and be responsible for the implementation results according to law.

If the purchaser adds new government procurement projects, changes or adjusts the procurement items, procurement quantity and budget amount of the approved government procurement projects, it shall correspondingly add and adjust the government procurement budget within the total budget expenditure of the approved department, and shall fill in the Adjustment Form for the Implementation of Government Procurement Budget (Annex 1) and submit it to the Provincial Department of Finance for examination and approval before implementation. Involving future annual departmental budget funding arrangements or the use of fiscal funds for repayment of borrowing funds procurement projects, it is necessary to obtain the consent of the budget management offices of the relevant departments of the Provincial Department of Finance, and implement the funding sources before filing the government procurement implementation plan.

The unused government procurement budget and departmental budget at the end of the year are carried forward synchronously, and the approved government procurement budget will be cancelled if the budget indicators are recovered; If the budget indicators are agreed to be carried forward, the purchaser shall implement it according to the government procurement budget issued after the carry-forward, and apply the centralized government procurement catalogue and procurement quota standard and open tender amount standard in the new budget year.

7. Strict planning and management.The purchaser shall prepare the government procurement implementation plan according to the approved government procurement budget and approved fund plan (see Annex 2 for the format), and report it to the Provincial Department of Finance for the record and obtain the plan number. The procurement items, quantity, budget amount and other contents of the government procurement implementation plan should be consistent with the approved government procurement budget and fund plan. The purchaser’s filing of engineering (Class B) projects shall also be in accordance with the "Implementation Measures for the Evaluation and Management of Financial Investment in Hunan Province"(Xiang Cai Ban [2011] No.16)Conduct financial investment review, and determine the budget amount of the procurement project implementation plan according to the conclusion of the financial investment review.

The purchaser’s adjustment of the implementation plan should be re-filed in time, and the budget adjustment and approval procedures should be performed first if it involves the adjustment of the government procurement budget.

8. Strict examination and approval management.Government procurement projects that meet the standard of public bidding amount need to adopt procurement methods other than public bidding, and purchase imported products, should be submitted to the Provincial Department of Finance for examination and approval in writing before the preparation of the government procurement implementation plan. The Provincial Department of Finance implements the time-limited settlement: from the date of receiving the application, it will give a written reply within 10 working days; If the material does not meet the requirements, it shall be revised and supplemented within 3 working days.

If the government procurement project intends to adopt the bidding procurement method, the purchaser shall specify the bid evaluation method in the procurement implementation plan; The lowest bid evaluation method should be adopted for goods and services with uniform standards such as technology and services; If the comprehensive scoring method is adopted, the score setting in the evaluation criteria should correspond to the quantitative indicators of the evaluation factors. If the government procurement project intends to adopt the non-tendering procurement method, the purchaser shall clearly invite suppliers in the procurement implementation plan.

9. Standardize agency behavior.The projects in the centralized procurement catalogue should be entrusted to the government procurement center of Hunan provincial organs to organize procurement; The project purchaser outside the catalogue may entrust a procurement agency to purchase, or organize the procurement by itself. Entrust a procurement agency, should comprehensively consider the client’s professional ability, management level and fees, and choose the best. The purchaser shall organize the procurement activities by himself, and shall not charge the supplier for the cost of procurement documents.

When the purchaser entrusts a procurement agency, it shall sign an agency agreement (for the format, see the Detailed Rules for the Implementation of the Measures for the Administration of Non-tendering Procurement by Hunan Provincial Government) to clarify the entrusted matters and the rights and responsibilities of both parties. The legal responsibilities of the purchaser, such as confirming the procurement documents, recommending suppliers, confirming the evaluation report, and confirming the successful bidder (transaction), shall not be entrusted to the procurement agency.

If a procurement agency collects agency service fees from the successful bidder (clinch a deal), it shall clearly inform the supplier of the limit and collection method of agency service fees in the tender (supplier invitation) announcement and project procurement documents.

10. Standardize expert extraction.In addition to the provisions of the Ministry of Finance, the evaluation experts should be drawn from the government procurement expert database. The purchaser and the procurement agency shall submit the extraction application online 3 working days in advance, and the system will randomly extract it within 24 hours before the evaluation and notify the evaluation experts. The evaluation of bidding documents, the demonstration of imported products and the demonstration of single-source procurement need not be drawn from the expert database of government procurement.

11. Relax access conditions.The purchaser and procurement agency shall clearly define the basic qualifications of suppliers participating in government procurement in strict accordance with paragraph 1 of Article 22 of the Government Procurement Law and paragraph 1 of Article 17 of the Regulations. Only the conditions mandated by laws and regulations or set for realizing the functions of government procurement policies can be regarded as specific qualification conditions. The purchaser and the procurement agency shall not require the supplier to provide certification materials other than the basic qualifications and specific qualifications for any reason. The registered capital, total assets, operating income, employees, profits, tax payment and authorization of manufacturers shall not be set as supplier qualification conditions, and small and medium-sized enterprises shall not be hindered or restricted from freely entering the government procurement market in their own regions and industries.

12, standardize the project review.In addition to the qualification examination identified errors, score summary calculation errors, sub-item scores beyond the scope of scoring standards, objective scores are inconsistent, and the evaluation committee unanimously identified the scores as abnormally high and abnormally low, the purchaser and procurement agency shall not organize re-evaluation. Under the above circumstances, if the result of winning the bid (clinch a deal) is changed after the purchaser reorganizes the review, or if the result of winning the bid (clinch a deal) is changed due to the query reply, the purchaser shall timely report the relevant information to the Provincial Department of Finance for the record, and inform the suppliers involved in the procurement activities and announce the reasons.

13. Implement policy functions.The purchaser shall implement the relevant policy functions of government procurement in the process of government procurement budget preparation and project review. The compulsory procurement items in the List of Government Procurement of Energy-saving Products shall be subject to government compulsory procurement; The products of prison enterprises and welfare enterprises can be given targeted support by setting specific qualifications; Non-mandatory procurement items in the List of Government Procurement of Energy-saving Products, products in the List of Government Procurement of Environmental Labeling Products, products listed in the Catalogue of Government Procurement of Two-type Products in Hunan Province and products of small and medium-sized enterprises shall be subject to preferential evaluation measures such as price deduction and extra points in bid evaluation in accordance with relevant policies and regulations. At the same time, for energy saving, environmental labeling and two-type products, the supplier shall choose one of them to enjoy the preferential evaluation; Only those who meet the national policy of promoting the development of small and medium-sized enterprises can enjoy the preferential review again. 14. The scattered fixed-point procurement with a cumulative amount of no more than 50,000 yuan can be announced and put on record after being merged regularly. The purchaser can organize the bidding of the shortlisted suppliers by himself, or entrust the government procurement center of the provincial government of Hunan Province to organize it.

Third, strengthen supervision and establish a strict accountability supervision mechanism for government procurement

15. Promote information disclosure.The purchaser and procurement agency shall, within 2 working days from the date of determining the supplier who won the bid (clinch a deal), announce the result of winning the bid (clinch a deal) and the tender documents, competitive negotiation documents or inquiry notice on the Hunan government procurement website, and the announcement period shall not be less than 3 working days; Within 2 working days from the date of signing the government procurement contract, the government procurement contract will be announced on the Hunan government procurement website, except for the contents involving state secrets and commercial secrets. If the purchaser entrusts an agency to issue an announcement, it shall review the contents of the announcement and bear corresponding responsibilities.

The contents of the announcement of the winning bid (transaction) results shall include:

(1) the name, address and contact information of the purchaser and the procurement agency, the project name and project number, the name and address of the supplier who won the bid (clinch a deal) and the bid (clinch a deal) amount;

(2) For goods procurement projects, the name, specifications, brand, manufacturer, quantity, unit price and service requirements of the goods shall be announced; For service procurement projects, the service list, service content and staffing list shall be published; For engineering procurement projects, the bill of quantities, material quantity and unit price, labor cost, etc. shall be published;

(3) List of suppliers participating in procurement activities, quotation, rating and qualification, compliance review and list of review experts. If the supplier is recommended in writing to participate in procurement activities, the recommendation opinions of the purchaser and evaluation experts shall also be announced.

The publicity of single-source procurement that meets the standard of public bidding amount, and the announcements of goods and services procurement projects with more than 10 million yuan (including: bidding announcement, pre-qualification announcement, competitive negotiation, invitation of inquiry procurement suppliers, announcement of bid winning and transaction results, announcement of procurement contract, etc.) shall be released simultaneously on Hunan Provincial Government Procurement Network (www.ccgp-hunan.gov.cn) and Red Net Government Procurement Channel (zfcg.rednet.cn).

The purchaser shall complete the contract filing within 7 working days from the date of signing the procurement contract, and the original method of signing the electronic contract online shall be stopped.

For government procurement construction projects and goods and services procurement projects related to the project construction to which the tendering and bidding law is applicable, the purchaser shall issue tender announcements, pre-qualification announcements and publicity of successful candidates in accordance with the regulations for the implementation of the tendering and bidding law, and provide links to relevant information for simultaneous reprinting on Hunan government procurement network. The purchaser shall, in accordance with the provisions of this notice, publish the winning contract online and put it on record.

16. Strengthen daily supervision.The Provincial Department of Finance will strengthen the supervision and inspection of government procurement activities of purchasers and procurement agencies according to law. Specific methods include: organizing special inspections, regularly sampling the bid-winning (clinched) projects, and irregularly checking the procurement activities of purchasers and agencies. The competent budget unit of the purchaser shall strengthen the guidance of the government procurement work in this system and perform the corresponding supervisory duties.

17. Build a credit system.The Provincial Department of Finance further refines relevant measures and formulates government procurement agencies and evaluation experts.andSupplier credit record standard; The establishment of bad behavior record management and publicity system, the illegal agency, evaluation experts.And suppliers, included in the list of bad behavior records, and to the public.

18, strict accountability.For violations of laws and regulations found in supervision and inspection, the Provincial Department of Finance will promptly handle and report them according to law, and urge rectification; For serious illegal acts and dishonesty in government procurement activities, the Provincial Department of Finance will jointly implement joint punishment with relevant departments according to law.

This notice shall be implemented as of the date of promulgation. If the consumer cannot use or return the charging treasure normally due to the operator’s reasons, the expenses arising therefrom shall be borne by the operator. Otherwise, the operator may constitute a breach of contract and infringe on consumers’ fair trading rights.

  Chaos 2: Still charge after return

  At present, there are still many kinds of charging chaos in the shared charging treasure market. The problem of "charging after returning" has become the hardest hit area for complaints in the field of shared charging.

  As mentioned above, the shared charging treasure operator and the consumer form a lease contract relationship, and when the consumer finishes charging and successfully returns the charging treasure, the lease contract between the two parties is terminated. At this time, the shared charging treasure operator no longer has the legal basis for charging the rental fee, and the continuous charging caused by the failure of its internal equipment or system does not display the successful return information. If the rental fee is still charged to the consumer, according to Article 11 of the Consumer Protection Law, the consumer has the right to compensation, and the operator shall return the overcharged fee and compensate the renter for the losses incurred.

  The Consumer Council of Shenzhen has conducted a related survey on multi-brand shared charging treasures, and the results show that 95% of the sharing charging treasures have not reminded consumers of the charging standards in a significant way. The price displayed when scanning the code for renting is inconsistent with the charge price when returning it, which is also one of the key points for consumers to vomit. However, the behavior of sharing charging treasure operators unilaterally changing the rental charging standard is suspected of violating the original lease agreement with consumers and infringing on consumers’ right to know. According to the relevant provisions of the Civil Code, the change of a contract must be agreed by the parties before it can have the corresponding legal effect. When the operator of shared charging treasure wants to change the charging rules, it needs to make a public announcement in advance according to the legal requirements, and take reasonable measures to remind consumers to pay attention and obtain the consent of the other party. Otherwise, the change of terms will not have legal effect on consumers, and the operator’s unauthorized change of charging rules and deduction of fees constitute a breach of contract. At the same time, according to the provisions of Article 8 of the Consumer Protection Law, consumers have the right to know the real situation of the goods they buy or use or the services they receive. Consumers have the right to request business operators to provide relevant information such as the price of goods or the cost of services according to the different conditions of goods or services.

  Chaos 3: the proliferation of false pop-up advertisements

  There is also the problem of the proliferation of false pop-up advertisements in the shared charging treasure: after scanning the code when using the shared charging treasure, Wang pops up the lottery interface of "charging and scratching". After he clicks on the prize and fills in his personal information, the page pops up the prompt of "You have purchased successfully". After asking the customer service, it was known that the personal information he submitted was deemed to have purchased the corresponding prize. In addition, when charging, some consumers have encountered an advertisement to push "enter the mobile phone number to receive high insurance for free", but after entering the phone number and personal information, they were "purchased" without knowing it, resulting in automatic monthly deduction and other fancy scams.

  According to the provisions of Articles 6 and 16 of the Measures for Punishment of Infringement on Consumers’ Rights and Interests, the information provided by business operators to consumers about goods or services shall be true, comprehensive and accurate, and they shall not mislead consumers by false or misleading propaganda, otherwise it will be considered as fraud. Article 148 of the Civil Code clearly stipulates that one party has the right to request a people’s court or an arbitration institution to cancel a civil juristic act committed by the other party against its true meaning by fraudulent means. Accordingly, the above-mentioned acts of deceiving consumers to buy goods or services in the name of free collection, or misleading consumers to shop with unclear and misleading propaganda expressions are all suspected of cheating consumers and infringing on consumers’ legitimate rights and interests such as the right to know. Consumers can request cancellation of the above-mentioned sales contracts and insurance contracts entered into by the sellers of related products or services by cheating consumers. At the same time, the Advertising Law also stipulates the contents of advertisements and their identifiability. Advertisers need to check relevant supporting documents and check the contents of advertisements according to laws and administrative regulations. Advertisers shall not publish advertisements with inconsistent contents or incomplete supporting documents.

  Therefore, as the publisher of pop-up advertisements, the shared charging treasure business enterprise has the obligation to review the content. If it fails to fulfill its obligation to publish false advertisements, or knowingly publishes and recommends false advertisements, which constitutes fraud to consumers or damages their legitimate rights and interests, it will be jointly and severally liable with advertisers, and consumers can also choose to ask charging treasure operators to pay compensation in advance.

  In addition, according to Articles 7 and 8 of the Interim Measures for the Administration of Internet Advertising, Internet advertisements should be identifiable and clearly marked with "advertisement"; Do not deceive users into clicking on advertising content. Article 5 of the "Regulations on the Administration of Internet Pop-up Information Push Service", which came into effect in September last year, also stipulates that third-party links, QR codes and other information that are maliciously diverted and jumped shall not be presented by pop-up information push, and users shall not be induced to click through the pop-up information push service to implement traffic fraud and traffic hijacking. Therefore, if the shared charging treasure applet tricks consumers into clicking on false advertisements by means of lottery, free gift, etc., it also violates the above measures and management regulations.

  Chaos 4: taking personal information for profit

  In the process of pushing false advertisements to users from the homepage of the shared charging treasure, operators often take personal information from users. Consumer Li once reported that after he successfully rented a brand shared charging treasure, the small program popped up a red envelope interface, guiding him all the way to the "Free Insurance" page, and he needed to fill in a full set of personal information such as his name, mobile phone number, ID number and address, and checked "I agree to get the insurance, and I have read the rules of the activity", but was later told that "if you meet the conditions for applying for insurance, the insurance company will contact you through the information you reserved."

  According to industry insiders, the above-mentioned lottery advertisement is actually a false advertisement for taking personal information of users and selling it to insurance intermediaries. Advertisers will pay advertising fees to the operators of shared charging treasures according to the number of sales leads collected, that is, the number of personal information. Users who submit personal information may be frequently harassed by phone messages such as product promotion and insurance agents.

  China’s Civil Code, Personal Information Protection Law, Consumer Rights Protection Law, Cyber Security Law and many other laws stipulate that the personal information of natural persons is protected by law, and no organization or individual may illegally collect, use, process or transmit other people’s personal information, or illegally buy, sell, provide or disclose other people’s personal information. Personal information should be handled in accordance with the principles of legality, legitimacy, necessity and good faith, and personal information should not be handled by misleading, fraud or coercion. Therefore, the operators of shared charging treasure push false advertisements containing misleading and fraudulent personal information to users’ pop-ups and provide them to insurance companies. It is illegal to illegally collect and use consumers’ personal information. If consumers suffer from privacy leakage or property loss due to filling in personal information in the above scenarios, they can ask the shared charging treasure business enterprise and the enterprise entrusted to publish the above advertisements to stop the infringement, eliminate the influence and even compensate for the losses. If the enterprise refuses to bear the corresponding legal responsibility, it can complain and report to the Consumer Protection Association, the market supervision and management department and the Internet management department.

  In addition, consumers should be reminded that they should choose to rent a shared charging treasure with a good reputation as far as possible, and pay attention to carefully reading the user agreement, especially the charging rules and return rules, to ensure that they receive the prompt of successful return and fill in their personal information carefully. Once the rights and interests are damaged, it is necessary to keep relevant photos, audio and video evidence, actively safeguard their legitimate rights and interests, and promptly complain to the regulatory authorities or defend their rights.
